By accessing or using www.instafunding.com (the "Site"), you agree to be bound by these Terms of Use and our Privacy Policy and Important Disclosures, which are incorporated by reference. If you do not agree, do not use the Site.

2. Nature of the Site

The Site provides general information about InstaFunding LLC and allows businesses to submit inquiries and applications for capital. InstaFunding provides capital through the purchase of future receivables; it is not a lender and does not make loans. Use of the Site, and submission of any application or inquiry, does not create a contractual, advisory, fiduciary, or other relationship with InstaFunding, and no funding relationship exists unless and until a definitive written agreement is executed by both parties.

3. Eligibility; Business Use

The Site and the products described on it are intended solely for businesses and business purposes. By submitting an application, you represent that you are authorized to act on behalf of the business identified and that the information you provide is accurate and complete. Capital provided by InstaFunding is for business purposes only and may not be used for personal, family, or household purposes.

4. No Offer; No Guarantee

Nothing on the Site constitutes an offer, commitment, or guarantee of funding, pricing, or terms. All funding is contingent on underwriting review and approval, and terms vary. Information on the Site is subject to change without notice and is not binding on InstaFunding.

5. Accuracy of Submitted Information

Submitting false, incomplete, or misleading information in connection with an application may result in denial, rescission of any offer, termination of any agreement, and other remedies available at law or in equity.

6. Intellectual Property

The Site and its content — including text, design, graphics, logos, and software — are the property of InstaFunding LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without prior written consent.

7. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) interfere with or disrupt the Site or its infrastructure; (c) attempt to gain unauthorized access to any systems or data; (d) scrape, harvest, or collect information from the Site by automated means; or (e) impersonate any person or entity in connection with the Site.

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, InstaFunding and its members, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to your use of the Site. In no event shall InstaFunding's aggregate liability arising out of or relating to the Site exceed one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless InstaFunding and its members, officers, employees, affiliates, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.

11. Governing Law; Venue

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Connecticut, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Connecticut for any such dispute, unless otherwise provided in a definitive written agreement between you and InstaFunding.

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
