Effective: August 2026. These Terms of Use ("Terms") govern access to and use of instafunding.com (the "Site"), operated by InstaFunding LLC. By using the Site, you agree to these Terms and to the Disclosures and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Site.

1. Use of the Site

The Site is intended for businesses and their authorized representatives seeking information about commercial funding solutions. You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information in any form you submit. You may not interfere with the Site's operation, attempt unauthorized access, scrape or harvest data, or use the Site to transmit malicious code.

2. No Offer; No Commitment

Content on the Site is informational only and does not constitute an offer, commitment, or solicitation to enter into any transaction. All products described are subject to underwriting review and are available only pursuant to definitive executed agreements. See the Disclosures, including the Not a Loan Disclosure.

3. Intellectual Property

The Site and its content — including text, graphics, logos, and the InstaFunding name and lion mark — are the property of InstaFunding LLC or its licensors and are protected by applicable intellectual property laws. No license is granted except the limited right to view the Site for its intended purpose.

4. Third-Party Links and Services

The Site may reference or link to third-party websites or services, including the separate licensed entity through which term loan products are offered. InstaFunding LLC is not responsible for third-party content, terms, or practices.

5. Disclaimers and Limitation of Liability

The Site is provided "as is" without warranties of any kind. The limitations of liability in Section 8 of the Disclosures apply to these Terms in full.

6. Indemnification

You agree to indemnify and hold harmless InstaFunding LLC and its members, officers, employees, and agents from claims arising out of your misuse of the Site or violation of these Terms.

7. Governing Law

These Terms are governed by the laws of the State of Connecticut. Exclusive venue lies in the state or federal courts located in Connecticut.

8. Changes

We may update these Terms at any time by posting a revised version. Continued use of the Site after posting constitutes acceptance.
